Sample Bequest Letter

Donors are encouraged to consult with their legal, tax or other advisors to properly coordinate their charitable gift or bequest to the Santa Fe Community Foundation. In addition to the sample language provided below, there is also a link below for advisors to download the Santa Fe Community Foundation’s determination letter from the Internal Revenue Service, which provides further detail regarding the Santa Fe Community Foundation’s tax-exempt status and its federal identification number.
“I devise to the SANTA FE COMMUNITY FOUNDATION, a New Mexico non-profit corporation, Santa Fe, New Mexico, or its successor entity, [the sum of ] [the following described property] [---% of my residuary estate] for its general uses and purposes.”
“I devise to the SANTA FE COMMUNITY FOUNDATION, a New Mexico non-profit corporation, Santa Fe, New Mexico, or its successor entity, [the sum of ] [the following described property] [---% of my residuary estate] to be used for [insert restricted use of funds]. If, in the opinion of the Board of Directors of the Santa Fe Community Foundation, all or part of this devise cannot be usefully applied to this purpose, the Board of Directors may use the devise for any purpose that in the Board of Director’s opinion will most nearly accomplish my wishes and purposes.”
“I devise to the SANTA FE COMMUNITY FOUNDATION, a New Mexico non-profit corporation, Santa Fe, New Mexico, or its successor entity, [the sum of ] [the following described property] [---% of my residuary estate] to be held, administered and distributed within the _______________ Fund. If the _______________ Fund is not in existence at the time of such distribution to it, then I devise [such amount] [such property] [---% of my residuary estate] instead to one or more funds (or all to one fund to the exclusion of others) then being administered by the Santa Fe Community Foundation, or its successor entity, or for the general uses and purposes of the Santa Fe Community Foundation, as my Personal Representative, in my Personal Representative’s sole and absolute discretion, shall select, and in such proportions as my Personal Representative shall decide.”
